MStars has learned that Real Housewives of Atlanta star Apollo Nida filed a motion asking for the federal judge to postpone his criminal hearing, claiming he is not ready for his court date.

Nida and his wife Phaedra Parks continue to confess his innocence, insisting that the father of two is not guilty of multiple federal charges including identity theft, conspiracy, bank fraud and more.

According to RadarOnline, court documents show that Nida filed papers on Feb. 10, asking for "an extension of time up to and including March 25, 2014."

The hold "will allow the parties sufficient time to discuss a potential resolution of this case," including a settlement, the documents state.

MStars previously reported that Nida is facing a long time behind bars for allegations of running a dirty business that stoled individuals identities to be used on multiple loan applications, and other necessities.

Parks has been linked to being involved in Nida's businesses, but the evidence that surfaced shows she has not been charged or even named in the case.
