10-year-old Girl Marijuana Arrest: Colorado Student Handcuffed, Charged after Bringing Father's Medical Mary Jane to School
A 10-year-old girl was arrested at her Colorado (Falcon District 49) elementary school after bringing her father's medical marijuana to class earlier this month (Nov. 13). The young student, who was handcuffed at the Evans International Elementary School and placed in the back of a patrol car, currently faces charges of possession of Mary Jane - and the girl's parents are utterly shocked. According to the father Carlos Figueroa - who is prescribed the medical marijuana for chronic pain, restless leg syndrome, and ADHD - his daughter understands that what she did is wrong and is sorry for her inappropriate actions. She was promptly expelled from the Evans school and now faces a December court date.
According to reports, the young student was caught with a small amount of pot in school on Tuesday morning (Nov. 13) after showing it off to a fellow peer. Law enforcement soon arrived and handcuffed and arrested the girl - she was later released to her parents. The 10-year-old now faces a petty offense relating to marijuana possession of less than an ounce.
Figueroa insists that he has always been open with his children about medical marijuana - his daughter knew that it is a presdribed medication only for patients and that she should never touch it. Still, a friend at school supposedly "told her to do it," so she stole a small amount from her father's personal room (which is typically locked).
Figueroa understands that his daughter must be penalized for her actions, but he finds the fact that she was handcuffed and carted away in a police car perturbing - "It really makes me feel insecure about my daughter being here and I don't like it at all."
But according to El Paso County Sheriff's Office spokesman Jeff Kramer, "When you look at it legally from the legal stand point, once the child hits the age of 10, then in the state of Colorado they have reached the age of mental culpability or committing a crime and being charged with a crime."
District 49 school representatives have yet to comment on the arrest, but they appear to have adhered to the facility's drug-free policy which reads - "Students violating this policy shall be subject to disciplinary sanctions which may include suspension and or expulsion from school and referral for prosecution."
The 10-year-old-girl's first appearance in court is December 12th.
