November might be one of the biggest party months of the year, as you have Thanksgiving Eve, Thanksgiving and of course, Black Friday, but with the partying comes the cops cracking down on drunk drivers. One of the stars of NCIS learned this the hard way earlier this month, as actor Michael Weatherly was pulled over and charged with a DUI.

According to TMZ, the star of the series was allegedly stopped by the cops for a speeding violation, but when they pulled him over they realized that he was driving under the influence. They proceeded to do a blood alcohol test where it was revealed that his BAC was over the legal limit.

PEOPLE is reporting that the 47-year-old was then brought to the police station where he spent 15 hours behind bars and was subsequently charged with two counts of DUI.

The star plays Anthony DiNozzo on the long-running CBS series and has been playing the role for over 12 years, as he originally joined the show in 2003.

Should he be convicted of the crimes, he could possibly spend up to six-months behind bars, but as this is his first offense, it is very unlikely that he will serve any jail time at all, according to FOX.

We previously reported on Weatherly's accomplishments of losing over 35 lbs. last year.

The star explained in a statement to PEOPLE, at the time, "Most importantly, I had more energy and more stamina. It's very hard. I go through periods of working so hard, I don't know when to exercise. And I'm surrounded by some food options that wouldn't be my first choice. But you do the best you can."

Weatherly has 3 kids: Liam and Olivia from current wife Bojana Jankovic, and a son, August, from his marriage to Amelia Heinle.
