Making A Murderer Update: Brendan Dassey May Not Get New Trial

Making A Murderer has stunned the nation, as Steven Avery and Brendan Dassey are believed to be wrongfully imprisoned for the rape, murder and dismemberment of Auto Trader photographer Teresa Halbach. While Avery has received several prospects for an upcoming trial, his nephew Dassey has not received much of the same hope. While the now 25-year-old is currently awaiting the chance for a new trial which may not happen.

Dassey was only 16 years old when he was taken in police custody for the gruesome crime. While many people have argued that the basis for his arrest was problematic, there should be automatic grounds for appeal. Being manipulated into confessing to a crime should be an automatic win but when it comes to the law its shaping up to be politics.

According to ENSTARS, Dassey's hopes of getting a new trial may be done the drain due to the Strickland standard.

Washington University School of Law Professor Peter Joy recently wrote about the Strickland standard and explained why it's very possible Dassey's new trial probably will not see the light of day.

"As a result of the Strickland standard, only the most outrageous consult by defense counsel leads to a new trial," he wrote. "In establishing the Strickland standard, the Court created conditions in which unequal assistance of counsel can thrive with little or no recourse for those adversely affected."

If you remember, the Wisconsin appellate court denied the claim that Dassey's attorney was not effective. Although his new attorneys can clearly prove that his former attorneys did not work in his best interest they are still working to gain a new trial.

For now Dassey still remains behind bars at Columbia Correctional Institution in Portage, Wisconsin.
