Miami Cop Fired 8 Times, Alleged Unsecure Storage Of Fire Arm Could Make 9: Sgt. German Bosque, Opa-locka Police Department's 6th Firing Attempt

Sgt. German Bosque of the Opa-locka Police Department in Miami, Florida, has been fired eight times from a number of different police departments, and is now being accused of leaving his AR-15 rifle with his girlfriend's father while he was on an eight-day-long sick leave last year.

CBS Miami refers to Bosque as the 'most disciplined, fined, fired and arrested police officer in the state.'  This is the sixth time that the Opa-locka Police Department has tried to fire him, with all previous attempts being unsuccessful.

The Opa-locka Police Department presented its case to dismiss Bosque on Wednesday, according to Yahoo! news.  "We're here on a very simple matter. It's going to be up to the arbitrator. We think what the officer did was wrong," Miami Attoney General Joe Geller said.

The hearing was before arbitrator Jeanne Wood, who will ultimately decide if Bosque's carelessness warrants his dismissal from the police department, CBS reports.  Wood said that she would issue a decision in about 60 to 90 days.  In addition, her arbitration could legally be rendered moot, even before a decision is issued.

The Miami Herald reports that past allegations that Bosque has been able to escape include having busted the skull of a handcuffed suspect, beating juveniles, having dope and alcohol in his squad car, ripping off suspects, falsifying reports, participating in an unauthorized chase during which four people were killed, and calling in sick from Cancun, according to CBS.

"Allegations are not convictions.  We have a system in place and that system is a fair system," argued Andrew Axelrad, Bosque's union-provided attorney, according to CBS.  Like many law enforcement officers, Bosque enjoys civil service and union protections.  The system has allowed him to continue to work as an officer despite the large number of allegations made against him, in addition to the jobs that he has lost in the past.

Attorney General Geller is arguing that Bosque violated the department's policy that an officer's weapon should be secured at all times, according to Yahoo!

Axelrad argued that the weapon was safe with the father of Bosque's now-fiance whom he calls "Daddy," and who is a licensed security guard, CBS reports.  He also said that there was no evidence the weapon was ever removed from the trunk of the car where the AR-15 was safely locked up.  

In addition, Axelrad argued that, "Anyone can legally purchase this weapon," according to CBS.  However, Geller countered this statement saying, "Not just anyone can purchase one from the Opa-locka police department."

After his last hearing, Bosque signed a deal with the city stating that one more strike and he would be out and the city argues that this constitutes a final strike, CBS reports.

At this point, the Florida Department of Law Enforcement, which is in charge of the licensing of cops, may have had enough, according to CBS.  They say that they will likely be recommending that Bosque's license be revoked at a de-certification hearing in that is expected to occur in the coming months.

The last straw for the FDLE was an incident when  Bosque allegedly ran criminal checks on people while off duty, CBS reports.  In the defense, however, Bosque's attorney claims the investigators have misread Bosque's work schedule in comparing it with the dates he was conducting the background checks.

Despite all of this Bosque continues to speak highly of his position as a police officer.  "I love serving the community.  I love what I do for a living and I'm very proud," Bosque told CBS on Wednesday.
