Microsoft Sued After Hard Drive Failures And Other Problems From Windows 10 Updates

Despite its real purpose to improve the experience of Windows 10 users, Windows Updates destroyed the data of some users. The automatic update installation caused data demise for Illinois group of Windows 10 users. And now, Microsoft is being sued for $5 Million.

According to Digital Trends, there are three people who filed class action suit against Microsoft for unwanted updates on Windows 10. A class action suit is one with a group of people is representing a group of bigger people with same injuries caused by the same product. With this said, the group is seeking for other Windows 10 users that had encountered the same problem from updating. Currently, there are over 100 class members already.

A Windows 10 user named Robert Saiger has given the update a try after declining it for six months, Ars Technica reported. But after the upgrade, Saiger's software malfunctioned and stopped working. And not only that, as the upgrade has resulted into data loss. Saiger stated that he incurred costs for fixing the damages happened after the upgrade. According to him, this is the result of the failure of Microsoft's Update to check for hardware or software compatibility before upgrade installation.

The suit is only accounted for losses from switching Windows 10 from Windows 7 which means that Windows 8 damages are not covered. It is said that hundreds or thousands of users has encountered this problem in United States. The suit makes Microsoft liable of $5 Million in damages.

Microsoft has responded to "The Register" about the matter over the weekend. Their response is that "customers had the option not to upgrade to Windows 10". They also pointed out the there is a free customer support and 31 day offer to roll back to older version of the OS. And they also added in their statement that the plaintiff's claims are without merit.
