Flo Rida managed to catch a huge break in his lawsuit with Mothership Music. The "Can't Believe It" rapper was being sued by the promoter for failing to appear at the Fat As Butter festival in 2011 for a hefty sum of $400,000. Due to travel constraints (MM is in Australia while Flor Rida presumably spends his days in Florida), Mothership subpoenaed Flo Rida over Facebook. It was this fact that torpedoed the whole case on appeal.
Justice Robert McFarlan put it thusly when he overturned the initial ruling in MM's favor:
"The evidence did not establish, other than by mere assertion, that the Facebook page was in fact that of Flo Rida and did not prove that a posting on it was likely to come to his attention in a timely fashion."
Basically, there was no proving that Flo Rida would receive the subpoena, therefore the ruling was thrown out.
What do you think of Flo Rida lawsuit ruling? Does he still owe Mothership Music? Is Facebook and acceptable way to subpoena someone?
