Philip Seymour Hoffman's gay rumors lawsuit: David Bar Katz sues National Enquirer Magazine for $50 Million over 'Gay' reports

Philip Seymour Hoffman's friend, David Bar Katz, is suing the National Enquirer for $50 million after they released a report that the pair were gay lovers on Wednesday, according to a press release by New York law firm Judd Burstein, P.C.

The lawsuit was filed in the New York Supreme Court, and Katz claims that the "exclusive interview" was bogus claiming:

"The story is a complete fabrication: There was no interview," it states. "Bar Katz and Hoffman were never lovers. Bar Katz did not see Hoffman freebasing cocaine the night before he died, or at any other time. Bar Katz never saw Hoffman use heroin or cocaine."

Attorney, Judd Burstein, added: "This article is just disgusting. Here you have Phil's family and his friends grieving, and the Enquirer comes along seeking to make a buck through putrid lies. Worse still, it appears that the Enquirer sent out a press release hyping the story so that it could sell more copies of the magazine. I do not know how these people can sleep at night."

New rumors are buzzing that the late Philip Seymour Hoffman and longtime friend, David Bar Katz were lovers and had secretly planned on a getaway before his death.

Katz found Philip's body Feb 2 in his New York home and the National Enquirer is reporting that  Katz is coming out with their relationship in a new interview, "We were homosexual lovers. We had a relationship," Katz told the magazine, "We were planning to go to the Super Bowl together and have a really nice day. This is so terrible."

The alleged news shocks fan since the actor recently ended a 14-year relationship with Mimi O'Donnell who he had three children with (Cooper, 10, Tallulah, 7 and Willa, 5.)

Katz says that he knew Philip was using heroin but thought he was clean, "I saw him last week, and he was clean and sober, his old self," he said in the statement. "

A source close to the family admit that the actor tried to get help in rehab and decided to move to Greenwich Village to live a different life, "One part of him wanted a normal family life while another part wanted heroin and the gay life." The source added, "Philip moved to Greenwich Village because it is the center of New York's gay community. The kids stayed with Mimi, but Philip saw them all the time."
