"Real Housewives of Atlanta" reality star, Apollo Nida is begging the judge in his conspiracy to commit fraud case to have pity on him before sentencing July 8.

According to RadarOnline, the 35-year-old fitness instructor wanted to have his Criminal History Category V changed to Criminal History Category IV, which would help Apollo avoid a potential maximum time of 30 years in prison.

Thursday, Apollo's attorneys stated in court documents:

"A criminal history category of V substantially overstates the seriousness of Mr. Nida's criminal past, thus warranting a departure from the Guidelines range," the file added, "Mr. Nida's lengthy but early small-time criminal history is simply not in the same league as the 'violent offenders, drug kingpins and perpetrators of far more serious offenses' that Criminal History Category V was designed to address."

According to TMZ, Apollo has been charged for identity theft after the Secret Service's Counterfeit and U.S. Treasury Check Squad alleged that the former convict created mock-up companies to obtain people's personal information for fraudulent reasons.

The entertainment site claims that the reality star then opened fake bank accounts and stole U.S. Treasury checks, stolen retirement checks from Delta Airline employees and unclaimed tax money.

Phaedra Parks has not been connected to the charges.
