Tracy Morgan Slaps Walmart With Lawsuit Over Deadly Crash

Comedian Tracy Morgan almost lost his life in a tragic accident that killed friend and fellow comic James McNair on June 7, 2014. Now that he is on the mend, he has filed a lawsuit against Walmart Stores for negligence on the part of the truck driver who hit his limousine.

The complaint - which was filed in U.S. District Court in NewJersey - states, "Walmart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries. As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation."

The suit claims the retail giant should not have allowed tractor-trailer driver Kevin Roper to drive while sleep-deprived; that he had to drive more than 700 miles and 11 hours from his Georgia home to a Delaware distribution center, when Walmart could have had him report to a closer location; and that Roper fell asleep at the wheel. At the time of the accident, Roper had been awake for more than 24 hours. National Transportation Safety Board investigators said that Roper was also going 20 miles per hour over the speed limit in a construction zone when he hit Morgan's limo.

Morgan's fellow passengers are also named as plaintiffs in the suit.

On Saturday, Walmart issued a statement in response to the lawsuit which said: "This has been a terrible tragedy. We wish Mr. Morgan, Mr. Fuqua Jr., and Mr. Millea full recoveries. Our thoughts continue to go out to them, their families and friends, as well as to the families and friends of everyone involved, including Mr. McNair who lost his life. We are deeply sorry that one of our trucks was involved. As we've said, we're cooperating fully in the ongoing investigation. We know it will take some time to resolve all of the remaining issues as a result of the accident, but we're committed to doing the right thing for all involved."

Also on Saturday, Morgan was released from the hospital. We wish him the best in his continued recovery!
