Tracy Morgan was spotted out in New Jersey with a walker on Wednesday, Dec. 3, for the first time since his six-vehicle car crash put him in critical condition this past June.

"Mr. Morgan is a fighter," the 30 Rock alum's lawyer Benedict Morelli told reporters outside of a New Jersey courthouse following a meeting with Wal-Mart attorneys. "He's fighting to get better. If there's a chance to be back to the Tracy Morgan he once was, he is going to try to do that. We just don't know. But is he doing much better? He's doing better," the star's lawyer said.

As Mstars News reported recently the former SNL comedian is still fighting a traumatic brain injury along with a slew of other damages done to his body during the accident that left fellow comedian and passenger James McNair dead.

As the photos portrays, Morgan is no longer wheelchair bound however he is walking with the help of a walker. The last time Mstars News reported his injuries the comedian was sitting in a wheelchair being wheeled into a New York City Hospital.

Fans have not heard the Tracy Morgan they once loved to laugh with, however they are hearing their beloved comedian fighting claims of the company that is responsible for his accident, injuries and death of a friend.

"After I heard what Wal-Mart said in court I felt I had to speak out. I can't believe Wal-Mart is blaming me for an accident that they caused," he said in a statement. "My friends and I were doing nothing wrong."
