Indianapolis Colts linebacker Josh McNary has been charged with rape, report Fox and ABC. Ahead of the NFL team's AFC Championship game against Tom Brady and the New England Patriots, Fox and ABC are reporting that 26 year old McNary — who has been with the team for two years and played all — has been charged with several offenses including rape and criminal confinement after an alleged incident late last year in Indianapolis.

As ABC Indianapolis report, "A warrant was issued for Colts LB Josh McNary on Wednesday for several charges including rape and criminal confinement."

They quote court documents saying that the victim met McNary at a bar in downtown Indianapolis and didn't know who he was. They go on to say that she went back to mCNary's apartment, where the assault took place.

According to ABC, "The told police she felt very drunk and fought with him before she passed out. Before she left the apartment, she said she took his phone to give to police as part of the investigation."

They add that Indianapolis police then "used the phone, surveillance video and information gathered in interviews to track down the victim's alleged attacker."

Fox59 report that the victim says "that a fight broke out before McNary allegedly raped her."

They go on to say that "A hospital examination reveled that the woman suffered injuries, including dried blood behind her ear. She told police she scratched her attacker. The victim told police that when she scratched McNary, he said, "Look what you did to me."

IndyStar.com report that McNary has been charged with "one count of rape, one count of criminal confinement and one count of battery, court documents state."

Sports Illustrated confirmed the reports, saying "Indianapolis Colts linebacker Josh McNary has been charged with rape, a Marion County, Ind., official told SI.com on Wednesday."

The Colts released a statement late Wednesday saying:

"We are aware that there has been a report about Josh McNary, but unfortunately that's the limit of our knowledge. At this time we are very concerned and trying to find out what the relevant facts are, but we have insufficient information to venture any opinion. As we learn more we will make appropriate updates."
