Eric Garner's Family Turns Down $5 Million Settlement From New York City

The family of Eric Garner, who died after being put in a chokehold by a New York Police Department officer, reportedly rejected a $5 million settlement from New York City for his death.

Garner was injured during an arrest attempt nearly a year ago, on July 17, 2014, in Staten Island and was placed in a chokehold by NYPD officer Daniel Pantaleo. He died at the scene from the chokehold -- a move that is banned by the NYPD.

New York offered the settlement for wrongful death, New York Daily News reports. The family has until Friday, the one-year anniversary of Garner's death, to file a lawsuit under the statute of limitations. They have said that they plan to sue the city for $75 million. The family may also file a suit against EMTs from Richmond University Medical Center, saying that he did not offer proper care.

Garner's death was captured on video, where he could be heard repeating, "I can't breathe." That phrase turned into a rallying cry for the Black Lives Matter movement, with prominent figures like LeBron James and Derrick Rose wearing it on t-shirts.

Officer Pantaleo was stripped of his gun and shield and works a desk job now. His lawyer said this week that he still wants to be part of law enforcement and would like to be back on active duty.

In early December, a grand jury decided to not indict Pantaleo for Garner's death. This decision led to a series of protests across the country and calls for police reform. New York City Mayor Bill deBlasio announced that city cops would be retrained, although officers reportedly gave the training negative reviews.

Pantaleo offered condolences to the Garner family in a statement after the grand jury decision to not indict was announced. In a press conference, Esaw Garner, Eric Garner's widow, firmly rejected Pantaleo's condolences.

"The time for remorse would have been when my husband was screaming to breath," she said. "That would have been the time for him to show some type of remorse or some type of care for another human being's life, when he was screaming 11 times that he can't breathe."
